1. Acceptance of Terms

By accessing or using Apixo ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you disagree with any part of the terms, you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Apixo provides a platform for hosting and serving JSON data as RESTful APIs. The Service includes data storage, API generation, analytics, and related features. We reserve the right to modify, suspend, or discontinue the Service at any time without prior notice.

3. User Accounts

When you create an account with us, you must provide accurate and complete information. You are responsible for safeguarding your account credentials and for any activities or actions under your account.

• You must be at least 13 years old to use this Service
• You may not share your account with others
• You are responsible for all content uploaded under your account
• You must notify us immediately of any unauthorized access

4. Acceptable Use

You agree not to use the Service for any unlawful purposes or to conduct any unlawful activity. Prohibited activities include but are not limited to:

• Uploading malicious content, malware, or code designed to harm others
• Hosting content that infringes on intellectual property rights
• Distributing spam, phishing content, or fraudulent data
• Attempting to gain unauthorized access to our systems or other users' accounts
• Using the Service to harass, abuse, or harm others
• Hosting illegal content including but not limited to copyrighted material without authorization
• Circumventing usage quotas through technical means
• Reselling or redistributing the Service without authorization

5. Content Ownership

You retain all rights to the data you upload to Apixo. By uploading content, you grant Apixo a worldwide, non-exclusive license to host, store, cache, and serve your content as necessary to provide the Service. We do not claim ownership of your content and will not access or use it for purposes other than providing the Service.

6. API Usage and Quotas

Each subscription tier includes specific usage quotas and compute bandwidth limits. You agree to operate within these limits. We reserve the right to suspend or throttle accounts that exceed their allocated resources or engage in abusive usage patterns. Abuse of the Service may result in immediate suspension or termination of access. Any matters related to billing, refunds, or payments will be handled in accordance with Paddle's applicable terms and policies.

7. Payment Terms

Paid subscriptions are billed in advance on a monthly basis and are processed by our authorized reseller and Merchant of Record, Paddle.

Refund Policy: You may cancel your subscription and request a refund within 14 days of purchase without providing any reason. To request a refund, contact support or use the cancellation option in your account settings. After the 14-day period, cancellations will take effect at the end of the current billing cycle and no partial refunds will be issued.

Refunds, cancellations, and chargebacks are handled in accordance with Paddle's refund policy and consumer terms. Apixo does not independently process refunds or payments.

Pricing may change with prior notice as required by applicable law. Failure to complete payment may result in suspension or termination of access to the Service.

8. Payments and Merchant of Record

Apixo uses Paddle as its authorized reseller and Merchant of Record. By purchasing a paid subscription, you agree that Paddle is responsible for payment processing, invoicing, taxes, refunds, and consumer rights in accordance with Paddle's terms and conditions.

9. Service Availability

While we strive for high availability, we do not guarantee uninterrupted access to the Service. The Service is provided "as is" without warranties of any kind. We are not liable for any downtime, data loss, or service interruptions.

10. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. You may also terminate your account at any time through your account settings.

11. Limitation of Liability

In no event shall Apixo, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of the Service.

12. Indemnification

You agree to defend, indemnify, and hold harmless Apixo and its affiliates from any claims, damages, obligations, losses, liabilities, costs, or debt arising from your use of the Service or violation of these Terms.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes by posting the new Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed and construed in accordance with applicable laws, without regard to its conflict of law provisions. Any disputes arising from these Terms will be resolved through binding arbitration in accordance with the rules of the applicable arbitration association.
